What are the necessary steps to initiate debt-collection proceedings in Spain?

If the debtor does not respond to amicable debt-collection attempts, and the analysis of the documents evidencing the debt, as well as the relevant information on the solvency of the debtor, warrant the initiating of judicial proceedings, the creditor will need to retain the representation of a court procurator and an attorney authorized to appear before the court in which the matter will be filed. To obtain such professional representation, the creditor must execute before the presence of a Spanish Notary, a general power of attorney, or a special lawsuit power of attorney, appointing the court procurator and attorney to act on the creditor’s behalf.
