In 1993, the Cámara de Comercio de Santiago A.G. (Santiago’s Chamber of Commerce Trade Association) created a mediation and arbitration center the primary role of which is to serve as a dispute resolution entity. Their arbitration processes operates basically through the following mechanisms:
Institutional Arbitration: The dispute resolution procedure is conducted by an arbiter empowered by the parties in conflict. Generally, a model arbitration clause is incorporated into the contract, in order to provide a recourse to this means of resolving any kind of difference or dispute which may arise out of the contractual relations established by that contract.
Mediation Services: These are an alternative method for resolving disputes by which a mediator, jointly elected by the parties in conflict, implements a dispute resolution procedure, based primarily on the proposals put forward during the process by the parties in conflict.
Another highly esteemed institution in our country, the Chilean American Chamber of Commerce (Amcham), also offers dispute resolution services through its Arbitration Center. Its register of arbitrators includes many prestigious lawyers who specialize in commercial arbitration.
These arbitration centers provide adequate services for the solution of eventual disputes between national and foreign parties.
