MEXICO - Clarification Regarding Documents for Short-Term Technical Assignments

This alert is an update to BAL’s February 8, 2010 alert (please click here). As previously reported, the National Immigration Institute has published formats for new migration cards that have replaced FM2 and FM3 booklets, effective April 30, 2010.
Under NAFTA, Mexico previously required Canadian and U.S. citizens to obtain an FM3 booklet in order to perform technical activities in Mexico. However, since the elimination of the FM3 booklet, Canadian and U.S. citizens are now allowed to perform technical activities under the FMN entry card issued at the airport. Therefore, under the new guidelines, it is no longer necessary to obtain a visa before entering Mexico for short-term assignments involving technical activities. Canadian and U.S. citizens may enter Mexico for up to 180 days with an FMN card.

The immigration authorities in Mexico are still reviewing policies under the newly- implemented immigration law. Because certain policies could change, business visitors to Mexico should confirm entry requirements prior to travel.
